Terms and Conditions

These Terms and Conditions govern your use of the websites, digital products, film access, media materials, forms, events, screening services, partnership resources, and related services operated by Center for Motivation Research.
In these Terms, “we”, “us” and “our” means Center for Motivation Research, an Australian incorporated non-profit organisation, ABN 84 109 838 718.
By accessing or using our websites, purchasing or renting digital access to our film, registering for any related product or experience, submitting a form, downloading media materials, hosting or enquiring about a screening, or otherwise using our services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, you must not use our websites, purchase or access our digital products, submit forms, download materials, or use our services.
1. Definitions
In these Terms:
“Content” means all text, images, graphics, logos, audio, video, film, trailers, documentary footage, interviews, written materials, downloads, course materials, media assets, design elements, software, and other material made available through our websites or services.
“DeINCEPTION” or “the Film” means the documentary film DeINCEPTION: The Great Aha! What Is Happiness?, including any trailers, clips, promotional materials, media materials, and related resources.
“Digital Products” means any digital film access, rental access, purchase access, online experience, course, companion material, downloadable resource, or other digital content made available by us.
“iReawaken Experience” means the companion reflective or experiential pathway that may be offered as a bonus with rental or purchase of the Film.
“Personal Viewing Access” means access granted to an individual for private, personal, non-commercial viewing only.
“Public Screening” means any screening, display, exhibition, stream, performance, showing, or viewing of the Film or any substantial part of it to a group, class, congregation, organisation, institution, business, paying audience, public audience, private event, conference, retreat, school, university, church, workplace, counselling group, coaching group, leadership group, or community group.
“Services” means our websites, Digital Products, Film rental and purchase access, forms, events, screening services, media resources, partnership resources, courses, companion experiences, newsletters, communications, and any related services.
“Websites” means deinception.com, thegreataha.com, motivationresearch.org, ireawaken.com, and any other website, landing page, platform, or digital property operated by us or used by us in connection with the Services.
2. Acceptance of these Terms
You agree to these Terms by:
- accessing or using our Websites;
- renting, purchasing, streaming, or viewing the Film;
- registering for any account, product, event, experience, bonus, or service;
- submitting any form, enquiry, media request, screening request, or partnership request;
- downloading or using any media materials, press materials, trailers, images, or other Content; or
- otherwise using or interacting with our Services.
If you use the Services on behalf of an organisation, institution, company, church, school, media outlet, platform, or other entity, you represent that you have authority to bind that entity to these Terms.
3. Changes to these Terms
We may update these Terms from time to time. The updated Terms will apply from the date they are published on our Website, unless otherwise stated.
Your continued use of the Websites or Services after updated Terms are published means you accept the updated Terms.
Where reasonably practicable, we may notify users of material changes. It remains your responsibility to review these Terms periodically.
4. Accounts, registration and access details
Some Services may require registration or account access.
When you register, purchase, rent, or activate access, you may be required to provide personal information such as your name, billing information, organisation name, or other relevant information. You must ensure that all information you provide is accurate, current, and complete.
You are responsible for keeping your login details, access links, passwords, and account credentials secure. You must not share, sell, transfer, publish, or otherwise make your access credentials available to another person.
You are responsible for all use of your account, access links, login credentials, and registered details, except to the extent caused by our negligence or breach of law.
We may suspend or terminate access if we reasonably believe that login credentials, access links, or account access have been shared, misused, obtained fraudulently, or used in breach of these Terms.
5. Age requirements
You must be at least 18 years old to purchase or rent Digital Products from us, unless you have the consent and supervision of a parent or legal guardian.
If a person under 18 uses our Websites or Services, a parent or legal guardian is responsible for supervising that use and ensuring the minor’s use is appropriate.
We do not knowingly permit children under 13 to create accounts or register for Services.
6. Nature of our content
Our Content and Services are provided for documentary, educational, philosophical, cultural, reflective, and informational purposes.
Our Content is not medical, psychological, psychiatric, counselling, legal, financial, crisis, or other professional advice. It is not a substitute for professional care, diagnosis, treatment, therapy, counselling, legal advice, financial advice, or emergency support.
Although DeINCEPTION and related materials may discuss happiness, motivation, suffering, meaning, personal change, counselling themes, philosophy, and the good life, we do not promise or guarantee any particular emotional, psychological, spiritual, financial, relational, educational, or life outcome.
If you are experiencing a medical emergency, mental health crisis, risk of harm, or urgent distress, you should contact emergency services or an appropriate qualified professional in your location.
7. Accuracy and completeness of information
We take reasonable care to provide accurate and useful information. However, the information on our Websites and in our Content may not be comprehensive, complete, current, or suitable for your particular circumstances.
To the maximum extent permitted by law, we do not warrant that any Content will be complete, accurate, current, uninterrupted, error-free, secure, or free from viruses or harmful components.
You are responsible for making your own assessment of the suitability of any Content, Digital Product, Film, companion experience, screening, partnership, or other Service before relying on it.
8. Digital film access and personal viewing licence
When you rent or purchase digital access to the Film, we grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Film for personal, private, non-commercial viewing only, subject to these Terms.
This licence does not transfer ownership of the Film or any intellectual property rights to you.
Unless expressly authorised by us in writing, you must not:
- copy, download, rip, record, reproduce, duplicate, broadcast, livestream, transmit, publish, upload, distribute, share, sell, resell, sublicense, or otherwise exploit the Film or any part of it;
- share your login details, access link, password, account, or viewing access with any other person;
- screen, show, display, exhibit, perform, or make available the Film to any group, class, audience, congregation, organisation, institution, business, event, school, university, church, community group, retreat, counselling group, coaching group, leadership group, or public audience;
- use the Film for commercial purposes, paid events, fundraising events, training programs, educational programs, workplace programs, professional programs, retreats, seminars, or conferences without our prior written permission;
- edit, alter, remix, translate, adapt, subtitle, repackage, or create derivative works from the Film or related Content;
- use the Film or Content for artificial intelligence training, machine learning, scraping, dataset creation, automated analysis, or data mining; or
- circumvent, disable, interfere with, or attempt to bypass any access control, digital rights management, streaming restriction, platform restriction, or security measure.
9. Rental access
Where rental access is offered, rental access provides personal digital viewing access to the Film for the period stated at the time of purchase.
Unless otherwise stated, rental access is for 30 days from the date of purchase or activation.
Rental access is for personal viewing only and does not include any right to download, copy, share, distribute, publicly screen, or commercially use the Film.
10. Purchase access
Where purchase access is offered, purchase access provides ongoing personal digital streaming access to the Film through our nominated platform or access method, subject to these Terms.
Purchase access does not mean you own the Film, own a copy of the Film, or have the right to download, reproduce, distribute, publicly screen, commercially exploit, or share the Film.
“Ongoing access” means ongoing personal access through the platform or delivery method we make available, subject to these Terms, payment confirmation, platform availability, technical requirements, rights restrictions, lawful changes, and any reasonable changes we may need to make to how the Film is delivered.
We will take reasonable steps to maintain access for purchasers, but we do not guarantee that any particular third-party platform, player, hosting service, login system, or access method will remain available indefinitely.
11. Prices, payments and taxes
Prices are displayed at the time of purchase. Unless otherwise stated, prices for Film rental or purchase may be listed in US dollars.
You are responsible for reviewing the price, currency, access period, product description, and purchase terms before completing payment.
Payments may be processed by third-party payment providers. We do not control all aspects of third-party payment processing and are not responsible for delays, errors, declines, fees, exchange rates, or other issues caused by your bank, card issuer, payment provider, or third-party platform, except where required by law.
You are responsible for any applicable taxes, duties, currency conversion fees, bank fees, or other charges that may apply to your purchase.
12. Refunds and Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, statutory right, remedy, warranty, condition, or other right that cannot lawfully be excluded, restricted, or modified.
To the extent permitted by law, we do not offer refunds for change of mind, accidental purchase, failure to use access during the rental period, or dissatisfaction where the Digital Product or Service has been provided as described and is not faulty.
Because Film rental, Film purchase, and companion experiences are digital products, you acknowledge that access may begin shortly after purchase. Once digital access has been supplied, refunds may not be available for change of mind, except where required by Australian Consumer Law.
If a Digital Product or Service is faulty, not supplied as described, inaccessible due to an issue within our reasonable control, or otherwise fails to meet a consumer guarantee, you may be entitled to a remedy under Australian Consumer Law.
If you experience a technical access issue, you should contact us within a reasonable time and provide sufficient details for us to investigate, including the details used to purchase, date of purchase, product purchased, device/browser used, and a description of the issue.
Where permitted by law, our liability for a failure to comply with a consumer guarantee may be limited to resupplying the relevant service or paying the cost of resupplying the relevant service.
13. iReawaken Experience bonus
Where stated, rental or purchase of the Film may include bonus access to the iReawaken Experience.
The iReawaken Experience is provided as a companion reflective or educational experience. It is intended to help viewers engage more personally with themes raised by the Film.
Access to the iReawaken Experience may require separate registration, login, or use of a third-party platform.
Unless otherwise stated, the iReawaken Experience is provided as a bonus and is not the primary product being purchased.
We may update, improve, modify, replace, suspend, or withdraw bonus materials where reasonably necessary, provided we do not limit any rights you have under Australian Consumer Law.
The iReawaken Experience does not provide medical, psychological, psychiatric, counselling, legal, financial, crisis, or other professional advice. We do not guarantee that participation will produce any particular personal, emotional, spiritual, psychological, behavioural, or life outcome.
14. Public screenings and group use
Personal rental or purchase access does not permit Public Screening.
You must obtain our prior written permission or a separate screening licence before showing, streaming, displaying, performing, or making the Film available in any Public Screening context.
This includes, but is not limited to, use in:
- schools, universities, colleges, classrooms, lectures, or educational institutions;
- churches, ministries, parishes, congregations, faith communities, or religious events;
- businesses, workplaces, leadership groups, staff training, or professional development settings;
- counselling groups, coaching groups, therapy-adjacent groups, retreats, workshops, or seminars;
- community groups, clubs, cultural forums, conferences, festivals, or public events;
- paid events, fundraising events, ticketed events, sponsored events, or commercial programs; and
- private gatherings where the Film is shown to a group beyond ordinary household personal viewing.
A screening licence may be subject to separate terms, fees, attendance limits, territory limits, promotional requirements, reporting requirements, discussion guidelines, or other conditions.
If there is any inconsistency between these Terms and a separate written screening agreement, the screening agreement will prevail to the extent of the inconsistency.
15. Media resources and press materials
We may make trailers, stills, posters, images, descriptions, press releases, media kits, biographies, interview topics, excerpts, and other media materials available for legitimate media, review, interview, editorial, educational, or promotional purposes.
Unless otherwise authorised, media materials may only be used in a fair, accurate, lawful, non-misleading, non-defamatory, and contextually appropriate way in connection with coverage, discussion, review, interview, or promotion of DeINCEPTION or related work.
You must not use media materials in a way that suggests false endorsement, partnership, sponsorship, affiliation, or approval by us.
You must not materially alter media materials, remove copyright or attribution notices, use them in offensive or misleading contexts, or use them to promote unrelated products or services without our prior written permission.
We may require removal or correction of any use of media materials that we reasonably consider inaccurate, unlawful, misleading, harmful, defamatory, unauthorised, or inconsistent with these Terms.
16. Partnerships, affiliates and collaborations
Submitting a partnership enquiry, media enquiry, screening enquiry, or collaboration proposal does not create a partnership, joint venture, agency relationship, employment relationship, contractor relationship, affiliate relationship, revenue-share right, licence, or obligation on us to proceed.
No person may represent themselves as our partner, agent, affiliate, representative, distributor, licensee, or authorised spokesperson unless we have expressly agreed in writing.
Any affiliate, referral, revenue-share, distribution, screening, media, educational, organisational, or partnership arrangement must be confirmed in a separate written agreement or written approval from us.
Affiliate or referral arrangements, if offered, may be subject to separate terms covering commission rates, tracking links, payment timing, refund adjustments, chargebacks, prohibited promotional methods, tax responsibilities, termination, and other conditions.
We may decline, suspend, or terminate partnership discussions or arrangements at our discretion, subject to any separate written agreement and applicable law.
17. User submissions and enquiries
If you submit information, ideas, proposals, messages, media enquiries, partnership enquiries, screening enquiries, testimonials, feedback, comments, or other material to us, you warrant that:
- you have the right to submit that material;
- the material is accurate to the best of your knowledge;
- the material does not infringe any third-party rights;
- the material is not unlawful, defamatory, misleading, confidential without authority, offensive, obscene, threatening, discriminatory, or otherwise inappropriate; and
- you are not submitting the material for an unlawful or unauthorised purpose.
You grant us permission to use, store, review, copy, respond to, and internally share your submission for the purpose of assessing, responding to, administering, or acting on your enquiry or relationship with us.
Unless we expressly agree in writing, you should not submit confidential business information, trade secrets, unpublished creative concepts, or sensitive personal information through general website forms.
Submitting an idea, proposal, or enquiry does not give you any ownership right, payment right, approval right, partnership right, or claim over any existing or future work, project, product, film, course, campaign, or business activity of ours.
18. Acceptable use
You must not use our Websites, Content, Digital Products, Film, forms, platforms, or Services in any way that is unlawful, harmful, misleading, abusive, unauthorised, or inconsistent with these Terms.
You must not:
- breach the privacy, intellectual property, contractual, moral, publicity, confidentiality, or other rights of any person;
- upload, transmit, or distribute viruses, malware, worms, Trojan horses, spyware, malicious code, or harmful material;
- attempt to gain unauthorised access to our systems, accounts, platforms, content, payment systems, forms, servers, databases, or networks;
- interfere with, disrupt, damage, overload, scrape, crawl, copy, reverse engineer, or attempt to bypass the operation or security of our Websites or Services;
- use our Content or Services to defame, harass, threaten, abuse, mislead, impersonate, or unlawfully target any person;
- post or transmit material that is defamatory, obscene, pornographic, racist, discriminatory, threatening, abusive, unlawful, or otherwise inappropriate;
- use automated tools, bots, scrapers, crawlers, data-mining tools, or artificial intelligence systems to collect, copy, analyse, train on, or extract Content without our prior written permission;
- use our Websites, Content, Film, Digital Products, or Services for any commercial purpose not expressly authorised by us; or
- misrepresent your identity, affiliation, authority, organisation, intentions, or relationship with us.
If we allow you to post, upload, submit, or transmit information through our Websites or Services, we may remove, moderate, refuse, restrict, or disable access to that material at our discretion.
19. Intellectual property
Unless otherwise indicated, we own or license all rights, title, and interest, including copyright, trade marks, designs, moral rights, confidential information, and other intellectual property rights, in the Websites, Content, Film, trailers, images, media assets, course materials, Digital Products, branding, design, software, and Services.
Your use of our Websites, Content, Film, Digital Products, or Services does not transfer any intellectual property rights to you.
Except as expressly permitted by these Terms, by law, or by our prior written permission, you must not copy, reproduce, download, distribute, publish, display, perform, communicate, modify, adapt, translate, create derivative works from, sell, license, exploit, or commercially use any part of our Content, Film, Digital Products, or Services.
All rights not expressly granted are reserved.
20. Personal and non-commercial use
Unless we expressly agree otherwise in writing, our Websites, Content, Film access, Digital Products, and Services are provided for personal, private, non-commercial use only.
You must not use the Film, Content, Digital Products, or Services for advertising, commercial training, revenue generation, paid events, organisational programs, institutional use, educational delivery, public performance, public screening, commercial promotion, or other commercial purposes without our prior written permission or a separate written agreement.
21. Third-party platforms, services and links
Our Websites and Services may use, link to, embed, or integrate with third-party services, including payment processors, video hosting platforms, email platforms, form providers, analytics providers, course platforms, membership platforms, hosting providers, social media platforms, and other technology suppliers.
We may also link to websites operated by third parties.
Third-party websites, platforms, tools, and services are not controlled by us. We are not responsible for their content, availability, security, privacy practices, terms, policies, fees, errors, downtime, or actions.
Your use of third-party platforms or services may be subject to their own terms and policies.
We provide third-party links and integrations for convenience and functionality. Unless expressly stated, a link or integration does not imply endorsement, sponsorship, or approval.
22. Privacy and collection notice
We collect personal information in order to provide and administer our Websites, Film access, Digital Products, screening enquiries, media enquiries, partnership enquiries, contact forms, newsletters, events, purchases, access credentials, support, and related Services.
The personal information we collect may include your name, phone number, billing details, organisation details, enquiry details, purchase history, account information, form responses, technical information, and communications with us.
We may collect personal information through website forms, WPForms, checkout pages, newsletter forms, screening forms, partnership forms, media forms, course or bonus access registration, analytics tools, embedded video services, payment processors, email marketing systems, and other service providers.
We may disclose personal information to third parties who help us operate our Websites and provide our Services, including technology providers, payment processors, communication providers, form providers, hosting providers, analytics providers, professional advisers, business partners, screening or event partners, and where required or authorised by law.
Some third-party providers may store or process information outside Australia.
If you do not provide requested personal information, we may not be able to provide all Websites, Digital Products, Film access, support, media services, screening services, partnership services, or related Services to you.
Our Privacy Policy explains how we collect, use, disclose, store, protect, access, correct, and handle complaints about personal information. By providing personal information to us, you consent to our collection, use, storage, and disclosure of that information in accordance with these Terms and our Privacy Policy.
23. Direct marketing and communications
If you subscribe, purchase, rent, register, submit a form, download materials, or otherwise engage with us, we may send you transactional, service-related, administrative, and, where permitted, marketing communications.
You may unsubscribe from marketing communications using the unsubscribe link provided in those communications, where applicable.
We may still send you non-marketing communications where required or reasonably necessary, including access information, purchase confirmations, support replies, legal notices, and service updates.
24. Promotions and competitions
From time to time, we may run promotions, campaigns, offers, contests, giveaways, or special events.
Additional terms may apply to those promotions. If you participate, you agree to the relevant promotional terms.
If there is any inconsistency between promotional terms and these Terms, the promotional terms will prevail to the extent of the inconsistency.
Promotions may be subject to eligibility criteria, time limits, territory limits, permit requirements, prize conditions, winner notification requirements, and other legal requirements.
25. Website security and technical risks
We do not guarantee that our Websites, platforms, downloads, embedded content, or third-party services will be uninterrupted, secure, error-free, or free from viruses or harmful components.
You are responsible for taking your own precautions to ensure that your devices, systems, browsers, accounts, and internet connections are secure and protected.
We are not responsible for loss or damage caused by viruses, malware, cyber incidents, platform outages, third-party service failures, user error, compromised accounts, or unauthorised access outside our reasonable control, except where required by law.
26. Suspension and termination
We may restrict, suspend, or terminate your access to our Websites, Content, Digital Products, Film access, accounts, forms, or Services if we reasonably believe that you have breached these Terms, misused access, infringed our rights, engaged in unlawful conduct, shared access credentials, made unauthorised public or commercial use of the Film, or otherwise acted in a way that may harm us, our users, our partners, our platforms, or our rights.
We may also suspend or withdraw a Website, feature, Digital Product, bonus, platform, or Service where reasonably necessary for maintenance, security, legal, technical, commercial, platform, rights, or operational reasons.
Termination or suspension does not affect any rights or obligations accrued before termination, including payment obligations, intellectual property obligations, confidentiality obligations, screening obligations, or liability for breach.
27. Warranties and disclaimers
To the maximum extent permitted by law, and subject to any non-excludable rights under Australian Consumer Law, we make no warranties or representations that:
- the Websites, Content, Film, Digital Products, bonuses, or Services will be uninterrupted, secure, error-free, current, complete, or free from harmful components;
- any particular outcome, result, transformation, emotional change, personal change, educational result, spiritual result, business result, or financial result will occur;
- the Websites, Content, Film, Digital Products, or Services will meet your personal expectations, preferences, circumstances, technical environment, or intended use; or
- third-party platforms, payment systems, video players, form providers, or hosting providers will always operate without interruption.
28. Limitation of liability
Nothing in these Terms excludes, restricts, or modifies any right, remedy, guarantee, warranty, condition, or liability that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary, punitive, or economic loss, loss of profit, loss of revenue, loss of opportunity, loss of goodwill, loss of data, business interruption, emotional distress, reputational harm, or other loss arising from or connected with your use of, or inability to use, our Websites, Content, Film, Digital Products, bonuses, screening services, media resources, partnership services, or other Services.
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or the Services is limited to the amount you paid us for the relevant product or service giving rise to the claim.
Where liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the relevant service or paying the cost of resupplying the relevant service.
29. Indemnity
To the maximum extent permitted by law, you agree to indemnify us, our officers, employees, contractors, volunteers, agents, licensors, partners, and service providers against any loss, damage, cost, expense, claim, demand, liability, or proceeding arising from or connected with:
- your breach of these Terms;
- your misuse of the Websites, Film, Content, Digital Products, media materials, screening access, partnership materials, or Services;
- your unauthorised copying, sharing, distribution, public screening, commercial use, or exploitation of the Film or Content;
- your infringement of our intellectual property rights or the rights of any third party;
- your unlawful, misleading, defamatory, harmful, or unauthorised conduct;
- your submissions, enquiries, proposals, uploads, statements, or representations to us or to third parties; or
- your breach of any screening, partnership, media, affiliate, or other separate agreement with us.
30. Force majeure
We are not liable for delay or failure to perform an obligation where the delay or failure is caused by events beyond our reasonable control.
This may include acts of God, natural disasters, power failures, internet failures, cyber incidents, platform outages, third-party provider failures, strikes, pandemics, government action, legal restrictions, war, terrorism, civil unrest, equipment failure, or other events outside our reasonable control.
31. Severability
If any part of these Terms is found to be invalid, unlawful, or unenforceable, that part will be severed to the extent necessary, and the remaining parts will continue in full force and effect.
32. No waiver
If we do not exercise or enforce a right under these Terms, that does not mean we waive that right.
A waiver must be in writing and signed by us.
33. Assignment
You must not assign, transfer, sublicense, or otherwise deal with your rights or obligations under these Terms without our prior written consent.
We may assign or transfer our rights or obligations where reasonably necessary in connection with a restructure, change of platform, service provider arrangement, transfer of rights, merger, acquisition, or other organisational change, provided this does not reduce any non-excludable rights you have under law.
34. Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia.
You submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in Victoria, Australia.
